Successful Verdict in Handicap Discrimination Lawsuit

Steven Adler, who joined the firm in January as Co-Chair of the Labor and Employment practice group, obtained a successful verdict in a handicap discrimination and failure to accommodate lawsuit after a one-week jury trial. The issues decided were whether the plaintiff created a materially enhanced risk of serious injury to his health or safety upon his return to work after a medical leave of absence, and whether the employer failed to engage in the interactive process in good faith to arrive at a reasonable accommodation.
